One of the government's efforts is to cut regulations that hinder investment by issuing the Job Creation Act. The birth of the Job Creation Act erases, changes and combines several applicable laws into one law through the concept of the Omnibus Law or commonly referred to as the Universal Sweeping Law. In response to these problems, we conducted research using a normative juridical approach based on primary legal materials. This research uses a statute approach and a conceptual approach with the technique of tracing legal materials using document study techniques and analysis of qualitative studies. The results of the study show that in principle the basic concept in the Employment Creation Act regarding Environmental Permits has not changed, which is still in accordance with the previous provisions. Changes are only related to providing convenience in obtaining environmental approvals with the intention that environmental permits are integrated into licensing trying to simplify the licensing system and strengthen law enforcement.
Ujang Badru Jaman, Ai Heni Nuraeni, Berliani Putri Pitaloka, Kiki Zakiyah Gadri Copyright (c) 2022 Libertas Law Journal https://libertas.nusaputra.ac.id/index.php/libertas/article/view/2 Fri, 03 Jun 2022 00:00:00 +0700 Normative Analysis of Criminal Penalty Reduction of The Pinangki Prosecutor by The Judge of The DKI Jakarta High Court https://libertas.nusaputra.ac.id/index.php/libertas/article/view/3
Pinangki Sirna Malasari is a Prosecutor who serves at the Attorney General's Office of the Republic of Indonesia who now has to languish in prison because the Prosecutor Pinangki has committed several criminal acts, which in legal theory are categorized as concurrent/combined criminal acts (Samenloop). In the process and course of his sentence, it creates problems from the public's perspective with what has been determined by the judge at the DKI Jakarta High Court. This is because Prosecutor Pinangki, who was originally at the Central Jakarta District Court, was sentenced to prison for 10 (ten) years, but after the defendant, Prosecutor Pinangki filed an appeal to the DKI Jakarta High Court, resulting in a reduced verdict and lightening the defendant, Prosecutor Pinangki. a sentence of 4 (four) years in prison. This is certainly interesting for the author to study, because there are so many responses stating that the law in Indonesia is so unfair. Apart from that, after there was a lot of discussion about the case, it certainly had an impact and influence on the community which resulted in the community also speaking up about the case. So that in this work the author conducts an analysis of the existing legal scientific theory with the practice of implementing law in the field.
Rida Ista Sitepu, Tedi Mulyadi, Agisna Kautsarani Copyright (c) 2022 Libertas Law Journal https://libertas.nusaputra.ac.id/index.php/libertas/article/view/3 Fri, 03 Jun 2022 00:00:00 +0700 Impact of the Implementation of The ASEAN Economic Community and the Job Creation Law For Labor https://libertas.nusaputra.ac.id/index.php/libertas/article/view/4
ASEAN as a regional organization in Southeast Asia has a vision to create a Southeast Asian region peaceful, safe, stable, and prosperous.
